Every state needs Florida’s burden shifting laws where there is a hearing that the state must prove their case by clear and convincing evidence before even arresting the defendant.
Arguing the witness isn’t credible and there is conflicting evidence etc is guaranteed to not have a judge boot your case for lack of probable cause. Those are issues of fact. Issues of fact are for a jury to decide. Issues of fact are not decided before trial like this. When viewed in a light most favorable to the state, does the evidence support a finding of probable cause for the charges of homicide? Of course it does. Just because the state could never meet a “beyond a reasonable doubt” standard at a pre-trial hearing (and likely at trial, too) is not lawful grounds to dismiss charges.
I would love this guy’s lawyer to argue that the multiple centuries old self defense framework is unconstitutional. Because, according to SCOTUS, we have a new previously undeclared fundamental right to self defense outside the home with a firearm. This would be the ONLY fundamental right that has a presumption against its lawful exercise. And that can’t possibly be constitutional. Shitty SCOTUS reasoning has consequences, and this is one of those consequences. The up side is that they may have forced Florida’s framework on every state by doing this. Just need some good defense lawyers to raise this issue.
