This is really what it boils down to... If they can charge you with failing to certify, then there must be a law that insists that you do. I would think we'd need to research from the county board of elections, their charter or bylaws, to see exactly what it is they're doing by the act of "certifying".

I know what it means to you and I. To you and I, I would think figuring out "what is it to cerify" would be like answering "what is it to breathe?", but it changes totally when you're speaking in terms of the court.

I would think the people in charge of doing their job would research just what it means to do their job, what's expected of you, and what it means to complete an action, and in what circumstances laws can be broken.

I thought I remember somewhere hearing that you cannot be compelled to break your oath of office, through law.

Well, I would bet you there is wording in the statute that says "shall certify," or something like that. This is part of the state codifying the election process (as it should). That's what they're basing this on. But there is no way you can convince me this was ever meant to be "shall certify" results which a county supervisor knows to be wrong or has good reason to believe are wrong.

And I would also bet you there is a criminal penalty (maybe another Class 6 felony?) for a county supervisor to certify election results he knows aren't correct. And "they made me do it" isn't a defense.

And that's what lawfare does. It uses the letter of the law to pervert the spirit of the law.

They sign their names to statements to the effect that they're satisfied the results are accurate, or the election isn't legal.

But if they don't sign, they face felony charges. Regardless of whether the results are straight nonsense. Why even have a board of supervisors?

There is no way that is legal. I do not believe it. Looks to me like they're lying, and hiding behind shitty legal advice, which coward politicians have done over and over and over when they want to avoid responsibility for their actions.

Remember the process is the punishment in lawfare. They can charge you, hold you, drag it out, nobody is going to do anything to help you because they're the ones doing it to you. Ultimately you could have charges dropped but not before you lose your job, family, years of your life and life savings and it costs them almost nothing. It's quite an evil racket.

Typically, coercion or fraud make any agreement invalid.

This isn’t an agreement between two parties, but a certification that election results are accurate.

But we have more than one official saying publicly that they are “forced” to sign their names to certify election results that they know to be inaccurate.

Its ilegal for me to give legal advise, but if I could give legal advise, it would be to collectively stand together and say no. Dare Hobbs to prosecute since she is the SOS and presumably can't enforce the criminal law, while the state AG works for the legislature not the [future] governor, and call Hobbs a threat to our democracy. There is still an issue of county district attorneys, but I don't think in a county like Yavapai they could get a conviction.

Giving legal advise is considered the practice of Law, and states have chosen to criminalize it. Those who can practice the law are defined by the state's highest court which is usually limited to attorneys, parties who represent themselves, jailhouse lawyers, parents for their kids in some instances but not others, maybe next friend is considered another one where a person is say incapacitated. The short answer is, I am not a attorney and there are laws against non-attorneys giving legal advise. If they lock me up, and I had access to outside communication, I wonder if I would have more speech rights as a jailhouse lawyer prisoner than a freeman.

UPL a really stupid law and rule if you ask me, and they often run afoul of the first amendment. Certainly advising someone to [imminently] violate the law isn't protected speech, but much needed political posturing for the local leaders to stand their ground in solidarity and lead. As to criminal charges, I expect it is a bluff and Hobbs is engaged in an textbook act of terrorism against the board of supervisors through intimidation as defined by the supreme court. There is still the ground of injuncti relief that could be sought and the courts can sort that mess out, but at some point the republican counties need to talk about succeeding from the state since their is no consent of the governed.

And no one is saying what the SPECIFIC charge is that would be a class 6 felony.

Also, if they refuse to certify based on the actions of a separate county they would clearly lose their argument that they were not being derelict in executing their duties. However if it were their OWN county where there was fraud or even a legally cognizable argument that there was fraud, and they refused to certify, they’d have a solid leg to stand on.

The proper way to address the fraudulent action of a separate county is to issue a resolution that they do not accept the certification of the other counties, and yes, certify under duress and the INVESTIGATE the county attorney threatening to have them arrested!

Why are they not calling out these county officials by name?!?!
