I'd be OK with abortion if there was an "opt out" legal procedure for men who don't want to be the baby daddy. Something that absolves a man of any and all claims for child support. I'm not talking late term abortion, let's say within the first 3 months of gestation.

I watched a video of a woman explaining why it's better financially to have 6 baby daddies on the sole for child support instead of one. (Link at end of comment) Predatory women like this do exist, and maybe they wouldn't be so promiscuous if men were simply given a choice to opt out. The drop in promiscuity would also lead to a drop in abortions.

It would give the man a choice. If abortion activists want to yell, "a womans body a womans choice" by not extending that right to men, the choice is essentially sexist in nature. Their base argument reduces women to being hapless victims, progeninating the problem.

I was born and raised around many ghetto women like the one example I put in the video I linked in the end.

The term "trap a baby daddy" is used because men are for no better term trapped. We have a court system that would rather give custody to a mother like this, even if the father is a completely upstanding citizen.

That being said, an opt-out compromise for men would be kryptonite for women like this. Their choices would be the following.

  1. Don't get pregnant (abstinence or birth control)

  2. Get an abortion.

Like most things if you remove the profit out of it, then the motivation for committing the act is essentially nullified. Abortion clinics hate the idea of giving fathers a choice because it cuts into their bottom line.

Ohhh ok ok. I get it now. Yes, that would be the minimally acceptable compromise to me.

However, I still think that solution does not address the real issue, and more importantly it would attempt to make legal something that does not actually exist/is a fabrication, something that only exists in our imaginations.

If you have a child, as a father especially, you can never "opt out" or escape that fatherhood. It's just not a thing. And the case in point is - think from the child's point of view.

Kid grows up, and wants to find their dad. What, you're just gonna tell them they don't have a dad? That's biologically inaccurate. You see this with adopted kids all the time where they try to find their "real" parents.

So I mean I get it from a legal standpoint, and trying to help men legally. But I don't like it because it's like the gay & trans stuff - trying to use the law, to make legal & to create something that does not really exist - in this case, escaping responsibility for bringing a life into this world or "opting out" of being a dad. No amount of paper or opt outs is gonna make you not a dad. Just ain't gonna happen.

There's a better answer somewhere, and yes an opt out clause might help with the trapping baby daddy issue. But discouraging casual sex, reinforcing family values, re-stigmatizing birth out of wedlock, etc, would all be better solutions to toxic baby mommas and the fatherlessness crisis.

Speaking to The New York Times in September 2020, Mary Hartnett, a law professor at Georgetown University who co-wrote the Ginsburg biography My Own Words, said Ginsburg believed "it would have been better to approach it under the equal protection clause" so Roe v. Wade would be less vulnerable to attempts to have it disbarred.

The due process clause of the 14th is: "...nor shall any State deprive any person of life, liberty, or property, without due process of law;"

The equal protection clause is the very next phrase: "nor deny to any person within its jurisdiction the equal protection of the laws."

I am not a lawyer, but I cannot see the right to an abortion (or even the right to privacy) in the due process clause of the 14th (nor the due process clause of the 5th). I do not understand the concepts of "substantive due process" enough to discuss it but it seems to me that if there is an unenumerated right to privacy, perhaps it might be found in the 4th, but not the 14th. Clearly better minds than me think this is not the case. Regardless, I agree with Thomas, to hell with all this "substantive due process" included in the penumbra of the constitution bullshit.
